These terms and conditions govern access and use of academy.teamtopologies.com (hereinafter, “Team Topologies Academy” or the “website”). 

FlowOnRails SL maintains this website, any courses offered and other materials for the use of its customers, vendors, students, and other website users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Team Topologies Academy.

By accessing the Team Topologies Academy you are accepting the contents of these Terms and Conditions, along with the Privacy Policy and Cookies Policy, and committing not to use them for any purpose which is illegal, unlawful or contrary to these terms or conditions.

Use of this website indicates acceptance of these Terms and Conditions and forms a binding agreement between you and FlowOnRails SL. If you do not agree to these terms, do not use this website.

The minimum age for use of this website is set at 18 years. In the case of minors, parents, guardians or legal representatives will be responsible.

3. DESCRIPTION OF THE SERVICE AND INFORMATION

By browsing “academy.teamtopologies.com” the user can find a series of pre-recorded courses for companies or individuals, created by Matthew Skelton and Manuel Pais, the authors of the book “Team Topologies”, or by third-parties (guest authors).

There are two ways of purchasing or contracting the courses:

• Individually: the users will purchase the course for their own use. They are not allowed to share access to the course with third-parties.

• As a package for companies: the user may purchase the course for a certain number of employees in their organization. Access to the course must be allocated to specific individuals. It is expressly prohibited to share an individual’s access among two or more employees.

Access to each course is regulated by the payment of a previously established fixed amount, so that if you purchase or contract the course you can immediately access the contents of the course on the platform, in addition to having the right to occasional support, the conditions of which will depend on FlowOnRails SL. For this, the user will have to register beforehand, and will be asked for some personal details.

3.1.PRICE AND FORMS OF PAYMENT

The courses offered, along with their prices, are available at “academy.teamtopologies.com”. In any case, FlowOnRails SL reserves the right to modify pricing as appropriate at any time without notice.

Payment for purchase of courses is made online:

• Individuals will pay by credit card, via Stripe.

• Companies will pay by credit card, via Stripe, or by bank transfer against an invoice.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

FlowOnRails SL reserves all its intellectual and industrial property rights, so that the content and information in the Team Topologies Academy (images, videos, texts, and other materials) are its property or it has the necessary authorizations for its use.

Any modification, reproduction, copying, distribution or any other form of exploitation for commercial or equivalent purposes of the content and information contained in the website is expressly prohibited. Any other use of the content or information requires the prior written consent of FlowOnRails SL.

FlowOnRails SL authorizes each User to access and view one copy of a course after purchase. Users may not modify the content or information from Team Topologies Academy in any way or reproduce, share or distribute them. Users will keep all course content confidential, and will not sell, auction, loan, rent, or give away, or otherwise reveal the content of a course, to any other person or entity. Any user that breaches these Terms and Conditions will automatically have their use of the Team Topologies Academy terminated.

5. TRADEMARK AND COPYRIGHT

Team Topologies, Team Topologies Academy, and certain other brands, trademarks, and service marks are marks of FlowOnRails SL, and its affiliates. The courses and other content on this website are copyrighted, and any unauthorized use of any materials on this website may violate copyright, trademark, and other laws.

6. LICENCE OF USE

The use of Team Topologies Academy requires the collection, processing and management, in a virtual and responsible way, of the data provided by the users.

Users are the owners of the content and personal information provided and FlowOnRails SL has only a non-exclusive license to such information, with the following limitations:

• The license will terminate at the time when users delete their data.

• The user’s consent will be required if FlowOnRails SL wishes to grant third-parties the right to use the content of the data.

7. OWNERSHIP OF DATA AND PRIVACY

Users are the sole owners of the data and information collected by the Team Topologies Academy. Data will be accessed for the sole purpose of providing the service in the best possible way. FlowOnRails SL will not use users’ data and information for any other purpose than the provision of the service unless there is express consent from the owners to do so.

In the event that data is communicated to third-parties, this will be done for purposes strictly related to the provision of the service, or when required by law.

8. WARRANTIES

FlowOnRails SL guarantees that the services offered will be in accordance with their description, subject to the following limitations:

• All implied warranties and conditions shall be applicable for the duration of the services offered, to the extent permitted by law.

• It does not cover problems caused by accidents, abuse or use of the services in an incompatible manner with the services offered, or arising from events beyond the reasonable control of FlowOnRails SL.

• It does not apply to periods of downtime or other interruptions in access.

9. TERMINATION OF THE RELATIONSHIP WITH THE USER:

9.1. RIGHT OF WITHDRAWAL IN THE CASE OF INDIVIDUALS

In application of the General Law for the Protection of Consumers and Users, the user has a period of 14 calendar days to notify FlowOnRails SL that the purchase or contract made is going to be cancelled. This clause applies only in case the individual user has completed 50% or less of the course that was purchased. In that case, the cancellation will be carried out without penalty or cost to the user.

Therefore, if you wish to exercise your right of withdrawal, you must notify FlowOnRails SL by email, indicating your express decision to withdraw from the contract.

To exercise the right of withdrawal, or to proceed with the refund, you must contact the owner of Team Topologies Academy, via email at: [email protected].

9.2. TERMINATION OF RELATIONSHIP DUE TO BREACH OF TERMS IN CASE OF LEGAL ENTITIES

In the event of termination of the contract due to breach of contract, or in the event that FlowOnRails SL is unable to provide the service, the customer will be entitled to a refund of the amount determined by FlowOnRails SL after studying the specific case, which will be refunded through the same method by which the payment was made.

This clause is not applicable in the event that the service is not available due to maintenance or similar needs of the website or platform. 

10. SECURITY AND LIMITATION OF LIABILITY

FlowOnRails SL will take the necessary measures to ensure the integrity of the service, and of the data and information collected, but will not be responsible for any events beyond its control.

Links to external websites or third-party platforms are provided solely as a convenience to the User. FlowOnRails SL has not reviewed all of these external websites, does not control and is not responsible for any of these external websites or platforms and their content. If you decide to access any of the external websites linked from “academy.teamtopologies.com”, you do so entirely at your own risk. FlowOnRails SL will not be responsible for what happens through the navigation on those websites or platforms.

This website is available in English. FlowOnRails SL is not responsible in the event that the user does not understand this language, nor for any actions that may result from their lack of understanding of the English language.

To the extent permitted by law, FlowOnRails SL is not liable for the incorrect or imprudent use of the Team Topologies Academy by its users.

In no event will FlowOnRails SL, its suppliers, or other third parties mentioned at this website be liable for any damages whatsoever (including, without limitation, those resulting from lower test scores, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this website, any websites linked to this website, or the materials or information contained at any or all such websites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.

11. MODIFICATIONS AND INVALIDITY

FlowOnRails SL reserves the right to update and modify these legal texts at any time without notice, and therefore recommends checking for changes each time the website is used or accessed. Your use of the website after such changes constitutes your agreement to said changes.

In the event that any clause of these Terms and Conditions, Privacy Policy or Cookies Policy is declared totally or partially invalid or ineffective, such invalidity or ineffectiveness will only affect the clause itself, with the other conditions remaining in force and the affected provision being deemed not to have been included.

12. APPLICABLE LAW AND COMPETENT JURISDICTION

These Terms and Conditions, and the Privacy and Cookies Policies, shall be interpreted and governed in accordance with Spanish law. In the event of a dispute, it shall be resolved by the Court of Arbitration of the Chambers of Commerce and Industry of Madrid, with the express waiver of any other jurisdiction that may apply, except as expressly provided by law.
